DISPUTE RESOLUTION (ADR) SERVICES
 We
are proud to offer mediation
and arbitration services. Most courts now require that cases
be submitted to mediation prior to going to trial. Simply
defined, a mediation is a process where the parties meet, usually
at a neutral site along with their attorneys, and a trained
mediator meets with the parties, and, through various means,
attempts to negotiate a settlement. Mediation has proven to
be a highly successful mechanism to settle cases, thus saving
the parties the substantial time, money, and emotional turmoil
that is inherent with taking a case to trial. We provide mediation
services that fulfill the court mandated ADR requirements.
Mike S. Bennett, Sr. is
a state licensed and court approved mediator. Mr. Bennett brings
to the table his more than 30 years of experience as a litigator
in various fields of the law, including family law, and personal
injury cases. Mr. Bennett has also obtained specific certification
as a divorce and family law mediator. Mr. Bennett has been very
successful in settling cases in his capacity as mediator—in many
of these cases, the attorneys involved did not think settlement
was possible.
Mr. Bennett is also a certified
arbitrator. Arbitration is a process by which the parties and
their attorneys submit evidence, testimony, and argument—much
like they would do at a trial—and the arbitrator decides the
contested issues—much like a judge would do at trial. The parties
agree beforehand whether the arbitrator’s decision is going to
be binding or non-binding. Arbitration, like mediation, is a
very successful mechanism to resolve cases.
Our mediation
and arbitration services are based at 1108 North Patterson Street
at the same location as the Bennett Law Firm, LLP. However,
we are fortunate to have separate
facilities in our annex building directly behind the main office.
Our annex building has multiple conference rooms and offices
that allow for ample space and creates a relaxed atmosphere
to conduct mediations.
